DISCLAIMER AND RELEASE OF LIABILITY

By purchasing, using, or permitting the use of any product sold by Saddlery Inc., Hilason Saddles, or any of their parent, sister, or subsidiary companies (collectively, the "Company"), you (“the User” or “Purchaser”) acknowledge and agree to the following terms:

Assumption of Risk

Horseback riding and all equestrian-related activities are inherently dangerous and involve substantial risk of injury, property damage, or death. These risks exist regardless of the skill or experience of the rider and regardless of the quality or condition of the equipment used. By participating in such activities and using our products, you knowingly and voluntarily assume all risks, both known and unknown, associated with their use.

Release of Liability and Indemnification

To the fullest extent permitted by law, you agree to fully release, discharge, hold harmless, and indemnify the Company, including its owners, officers, directors, employees, agents, contractors, and affiliates, from any and all claims, demands, causes of action, liabilities, damages, losses, or expenses (including attorneys’ fees) arising out of or in any way related to the purchase, use, misuse, failure, or defect of any product supplied by the Company.

This release applies to all legal theories, including negligence, strict liability, or breach of warranty, whether caused by the Company’s own negligence or otherwise.

No Warranty – Products Sold "As Is"

All products are sold “as is” and without any express or implied warranties, including but not limited to warranties of merchantability or fitness for a particular purpose. It is your responsibility to ensure all equipment is inspected before each use, maintained properly, and used only as intended and with appropriate caution.

The Company makes no guarantees that any product will prevent injury or perform safely in all circumstances.

Return Policy

If you do not agree to the terms of this Disclaimer and Release, you must not use the product and should return it unused and in new condition within the return period for a full refund.

Governing Law and Jurisdiction

This agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any disputes, claims, or legal actions arising out of or related to this agreement or the use of any product sold by the Company shall be brought exclusively in the state or federal courts located in Fort Bend County, Texas, and you consent to the personal jurisdiction of such courts.

By completing your purchase, you acknowledge that you have read, understood, and voluntarily agreed to this Disclaimer and Release of Liability in its entirety.
